CPTPP: Eggs TRQ - Serial No. 991

This Notice replaces Notice to Importers No. 949 dated October 1, 2019, and sets out the policies and practices pertaining to the administration of Canada’s tariff rate quota (TRQ) for eggs under the Comprehensive and Progressive Agreement for Trans-Pacific Partnership (CPTPP).
This Notice is provided pursuant to the authority of the (EIPA) and its corresponding , and remains in effect until further notice.

1. Definitions
Eggs and egg products means a product that is included in Items 135 to 139 on the (ICL), namely eggs and egg products falling under tariff items 04.07, 04.08, 21.06 or 35.02 in the list of tariff provisions set out in the Schedule to the .

2. Allocation policy
- To be eligible, you must be active in the Canadian eggs and egg products industry at the time of application, and must remain active regularly during the quota year.
- Note: You must, in addition, have been active regularly in the Canadian eggs and egg products industry during the reference period.
- All applicants must provide a list of related persons.
- You must specify in your application the minimum quantity of quota you will accept. If your calculated market share allocation amounts to less than 25,000 dozen, you are issued an allocation only if the quantity you have specified in your application is lower or equal to your calculated market share allocation.
3. Eligibility criteria
You are eligible to apply for an allocation if you are:
- A federally-registered processed egg station (breaking eggs);
- A federally-registered egg grading station (table/shell eggs).
4. Calculation of allocations
- The allocation to federally-registered processed egg stations (breaking eggs) is calculated first in proportion to each station’s market share.
- Note: Market share is calculated on the basis of the dozens of eggs broken by the individual applicant during the reference period in proportion to the total dozens of eggs broken by all applicants who receive an allocation.
- Once the requirements of the eligible breaking egg applicants have been met, any remaining quota is allocated to federally-registered egg grading stations (table/shell eggs) in proportion to each station's market share, adjusted for surplus declarations.
- Note: Market share is calculated on the basis of the dozens of eggs graded by the individual applicant during the reference period in proportion to the total dozens of eggs graded by all applicants who receive an allocation.
5. Transfer, return and under-utilization of allocations
- If you wish to transfer any portion of your allocation, you must submit a transfer request form .
- You may return any portion of your breaking eggs allocation to the Department in writing by the prescribed return date.
- Note: Returned quantities will normally be made available seven days after the return date to eligible allocation holders in the breaking egg group, who have not returned any portion of their allocation, in proportion to their initial allocation, or on demand if quantities still remain after the first offer.
- If you use less than 95% of your allocation for breaking eggs and 90% of your allocation for shell eggs in one year, you may have your allocation adjusted downward by an under-utilization penalty in the following year.
- Note: Any portion of your allocation that you transfer or return in accordance with the present policy is considered to have been used.
6. Import permits
- To obtain an import permit, you must inform the Regional Office of the in writing, prior to importation, of the quantity of eggs that you expect to import, the date of importation, and the identity of the federally-registered establishment to which the eggs are to be delivered.
