CPTPP Dairy Tariff Rate Quotas (TRQs) Panel report implementation and other administration policy changes: Closed consultation

¶¶ÒùÊÓƵ was seeking on the Comprehensive and Progressive Agreement for Trans-Pacific Partnership (CPTPP) dairy tariff rate quotas (TRQs) panel report implementation as well as other administration policy changes.
Stakeholders had until 11:59 p.m. (Pacific Time) on March 7, 2024, to submit their responses, comments and suggestions.
Why was this consultation held?
On September 5, 2023, the Panel in the CPTPP dairy TRQs dispute issued its final report. While the Panel found in Canada’s favour on 2 claims, it also identified non-conformities on 2 claims that Canada had the obligation to eliminate:
- Canada’s pools are inconsistent with the Agreement because, according to the Panel, they limit access to an allocation to processors “by reserving priority access to [Canada’s] 16 dairy TRQs to processors”.
- Canada’s existing Notices to Importers are inconsistent with the Agreement because, according to the Panel, Canada’s pooling system “operates to limit the opportunity for otherwise eligible applicants to use the TRQs fully”.
In addition, Canada considered making further changes to certain CPTPP dairy TRQ administration policies.
The feedback received helped inform the decisions of the Minister of Export Promotion, International Trade and Economic Development in implementing the CPTPP dairy TRQs dispute panel report and in making any other administration policy changes.

The department was seeking input from all stakeholders with an interest in this matter, including:
- the Canadian public;
- provincial and territorial governments;
- producers, processors, further processors, distributors, retailers, food service, and importers;
- small- and medium-sized businesses;
- national, provincial, and regional associations;
- international trading partners.
