Exports of Refined Sugar to the United States under World Trade Organization Commitments - Serial No. 1059

This Notice sets out the policies and practices pertaining to the administration of the refined sugar tariff rate quota (TRQ) referred to in subparagraph 2(a) of Article 3.A.5 of Annex 3-A of Chapter 3 of the Canada-United States-Mexico Agreement (CUSMA).

This Notice is provided pursuant to the authority of the (EIPA) and its corresponding , and remains in effect until further notice.

Definitions

Originating Sugar means a product that is included in Item 5204 (a) on the Export Control List (ECL), namely refined sugar as set out in subparagraph 2(a) of Article 3.A.5 of Annex 3-A of Chapter 3 in CUSMA, which is wholly obtained from raw sugar beets produced in Canada.

Domestic Market Production Share means a share of domestic production of Originating Sugar during the reference period.

You will receive an allocation based on your Domestic Market Production Share.

Return and reallocation of allocations

In any year in which there is more than one allocation holder, you may return any portion of your allocation to the Department in writing by the prescribed return date. Any returned allocation will be offered to other allocation holders on an equal share basis.

Permits and Certificates of Quota Eligibility

Shipment–specific export permits are required to export any good provided in item 5204 (a). In addition, for quota access, a U.S. Certificate of Quota Eligibility (CQE) must be obtained from ¶¶ÒùÊÓƵ for presentation to U.S. Customs and Border Protection at time of entry. Eligible allocation holders will receive CQEs upon receipt of their annual allocation. Additional CQEs are available upon request.
