Canada commends Tunisia for the adoption of the organic law on the elimination of violence against women, the adoption of a decree allowing Tunisian women to marry non-Muslim men, and the adoption of the organic law on the elimination of all forms of racial discrimination.
Canada recommends that Tunisia:
- Revise the Code of Military Justice and other relevant legislation to prohibit the trial of civilians in military courts.
- Repeal Article 230 of the Penal Code which criminalizes sexual relations between consenting adults and eliminate discriminatory practices based on sexual orientation and gender identity.
- Repeal the 1978 Decree regulating the state of emergency and the 1975 Decree establishing the powers of the Ministry of the Interior, or revise them to remove their freedom-restricting provisions.
- Amend Orientation Law n°2005-83 in order to rectify the definition of disability and integrate a human rights approach.
Canada encourages Tunisia to preserve the gains of the 2011 Revolution, including Decree-Law No. 2011-88 on the organization of associations, and to ensure a balance of power. Canada also encourages Tunisia to guarantee freedom of religion and conscience.
